Lucas sues Jedi Mind, Inc.

Take note, fan boys and girls; do not try to make a buck off of your favorite Sci-Fi franchise, especially not LucasFilm.

Jedi Mind, Inc. is the developer of Jedi Mouse and Master Mind software. Their revolutionary thought-controlled software could be the next thing in gaming controls. Their Master Mind software grants gamers the ability to play video games with the “power of their mind.” Supposedly, Master Mind is compatible with World of Warcraft and Call of Duty, but I was unable to find any kind of video or gamer reviews to back up this claim.

Unfortunately, Jedi Mind, Inc. chose the wrong franchise to infringe on. Their business name alone warrants a legal stomping from LucasFilm, but they went one further using the Jedi name in their software titles. I expect this to be the epic battle of the ant and the magnifying glass, the poor ant has no chance.

Unsurprisingly, Lucas is all over this like white on rice. LucasFilm sent a cease-and-desist letter to Jedi Mind in May of 2009. Jedi Mind offered to phase out Jedi Mind marks but while LucasFilm agreed to the offer they now claim that Jedi Mind reneged. LucasFilm sent a second cease-and-desist in September and offered to work the issue out without a lawsuit.

The force is not strong with this one, LucasFilm is now suing Jedi Mind claiming the trademark infringement could lead to confusion and harm LucasFilm’s business and reputation. Lucas film is seeking an injunction and recovery of damages no less than $5 million.

While LucasFilm does not directly hold trademarks on Jedi Mind, they claim dominion over “all characteristics associated with Jedi knights not memorialized in a registered trademark… (including) Jedi robes, the lightsaber weapon, the power to levitate objects, a telepathic oneness with other Jedi and the universe, and the ability to shoot energy beams called ‘Force Lightning’ from the fingertips.”

Here is my short skit on how I expect this whole thing went down;

LucasFilm: Stop stealing our ideas and profiting from our work!
Jedi Mind: [/waves hand] These aren’t the trademark infringements you are looking for.

LucasFilm: Srsly. Stop. It’s not working. If you stop we won’t sue.
Jedi Mind: These aren't the trademark infringements you're looking for.
LucasFilm: 0-o Are you dumb? Have you met our attorneys?

Jedi Mind: We can go about our business.
LucasFilm: You can’t go about your business. We are suing. We will destroy you and make you wear Princess Leia’s slave suit for our amusement.

Jedi Mind: /gulp.
LucasFilm: Roflmao… all your money are belong to us.
